The content is protected by copyright under both New Zealand and foreign laws. Modification or use of the materials for any purpose not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other applicable laws and Goblin Games NZ's intellectual property rights. The material in this site is provided for lawful purposes only. All rights not expressly granted herein are reserved to Goblin Games NZ. If you violate any of these Terms and Conditions, your limited license to use the Site and related content automatically terminates.

 

RESTRICTION OF LIABILITY

The use of the Site and the related content is at your sole risk. Goblin Games NZ will not be liable for any damages or injury, including, but not limited to, any damages or injury caused by any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. Goblin Games NZ will not be liable for any damages or injury (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) that result from the use of, or the inability to use, the materials in this site, even if there is negligence or Goblin Games NZ or an authorized Goblin Games NZ representative has been advised of the possibility of such damages, or both. TERMINATION

GOBLIN GAMES NZ may terminate or suspend your right to use the Site at any time. Your right to use the Site shall terminate immediately and automatically if you should breach any of these Terms and Conditions. You agree that the following actions shall constitute a breach of these Terms and Conditions:

1. Using the Site for any purpose in violation of local, state, national, or international laws;
2. Using material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
3. Using material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by Hobby Master in its sole discretion;
4. Distributing viruses or other harmful computer code;
5. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Site, or which, in the judgment of Goblin Games NZ, exposes Goblin Games NZ or any of its customers or suppliers to any liability or detriment of any type.

In addition, Goblin Games NZ shall have the right, but not the obligation, to suspend or terminate your account at any time in the event Goblin Games NZ has any reason to believe, in its sole discretion (whether by reviewing its daily login tracker, reviewing its IP address tracker or otherwise), that your account is being misused or that your login or account information may be compromised.

 

INDEMNITY

You agree to defend, indemnify, and hold Goblin Games NZ, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable attorneys' fees, resulting from, or alleged to result from, your intentional or unintentional violation of these Terms and Conditions.

 

JURISDICTION AND VENUE

You expressly agree that exclusive jurisdiction for any dispute with Goblin Games NZ, or in any way relating to your use of the Site, resides in the courts of New Zealand and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of New Zealand in connection with any such dispute including any claim involving Goblin Games NZ. These Terms and Conditions are governed by the laws of New Zealand, without respect to its conflict of laws principles.

 

MISCELLANEOUS

If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Possible evidence of use of this site for illegal purposes will be provided to law enforcement authorities. This is the entire agreement between the parties relating to the use of this site. Goblin Games NZ can revise these Terms and Conditions at any time by updating this posting. Goblin Games NZ products and services are available in many parts of the world. However, the Goblin Games NZ site may describe products and services that are not available worldwide. This site may be linked to other sites which are not maintained by Goblin Games NZ. Goblin Games NZ is not responsible for the content of those sites. The inclusion of any link to such sites does not imply endorsement by Goblin Games NZ of the sites.

 

ORDERS

Goblin Games NZ reserves the right to refuse any order placed on the Site. Goblin Games NZ may, in its sole and absolute discretion, limit or cancel quantities or any order for any reason. In the event Goblin Games NZ changes or cancels your order, Goblin Games NZ will attempt to notify you by sending you an e-mail and/or contacting you via the billing address/phone number provided at the time your order was made. Goblin Games NZ reserves the right to refuse sell orders and donations.

 

PRODUCT AND AVAILABILITY

All products on the website are representative of products available to purchase online through the website as well as stock that may be taken to conventions. Please note, there may be some variation with the images shown on the website and the actual product itself. In some instances, products/items may be missing or unavailable to purchase. In such instances, the discrepancy will be communicated to the customer as soon as possible via email or phone.

 

PRICING DISCLAIMER

At Goblin Games NZ your satisfaction is our top priority and we are committed to maintaining accurate product and pricing information for our customers. At times, certain pricing errors may occur. In the event an item is listed and or priced incorrectly due to an error in pricing or product information, Goblin Games NZ shall reserve the right, at our sole discretion, to refuse or cancel any orders placed for that item. We may, at our discretion, either contact you for instructions or cancel your order and notify you of the cancellation.

 

SHIPPING

Orders will be shipped from Miramar, Wellington. Goblin Games NZ aims to ship orders within 48 hours of receiving them. We will notify customers of any delay with shipping via email.  Projected delivery for courier items is overnight.  Items sent by NZ Post mail service are not tracked and we cannot confirm delivery times for these.  Items sent by NZ Post are not insured and Goblin Games NZ accepts no responsibility for their loss or damage.  Items sent by Courier are insured.  Goblin Games NZ orders that are received Monday to Friday before 2pm will be sent out that day.  Orders received after this time will ship the following day.  Goblin Games NZ does not ship on the weekends or on Public Holidays.

 

PICKUP OR DELIVERY

Pickup or delivery for orders may be arranged through email or social media contact, the terms of which will be discussed and agreed to on a case by case basis.

 

BUYLIST ORDERS

Buylist orders can be put towards store credit or deposit via bank transfer. Sell orders can be shipped to Goblin Games NZ or be handed in directly in-store. Goblin Games NZ is not responsible for any damage or loss in the process of shipping the sell order to us. Cards will be checked and graded in the condition we receive them. Once received, sell orders will be checked for condition and authenticity, and our offer adjusted accordingly. Once a final value has been assessed an email will be sent out for customer approval before any funds are transferred. If we do not receive a reply within 7 days, this will be considered as an approval and the funds will be transferred. Any problems or disputes regarding the value offered must be made within these 7 days as once the funds are transferred the sell order will be finalized.
